1. The App and who may use it
Tic Tac Battle (the "App") is an entertainment game published by Pulsebyte ("Pulsebyte", "we", "us"). You may use the App if you are at least 13 years old (or the minimum age for digital services in your country) and, if you are a minor, with the permission of a parent or guardian who accepts these Terms on your behalf. Our handling of information is described in the Privacy Policy, which forms part of these Terms.
2. Licence
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial entertainment. All rights not expressly granted are reserved by Pulsebyte.
3. Acceptable use
You agree not to, and not to help anyone else to:
- copy, modify, translate, sell, rent, lease, or distribute the App or any part of it, except as permitted by law;
- reverse engineer, decompile, disassemble or try to extract the source code, assets, or game logic of the App, except where applicable law expressly allows it despite this restriction;
- use cheats, hacks, memory editors, modified or unofficial builds, automation, or any method to alter saved data, coins, rewards or rankings;
- circumvent, disable or interfere with any security, time-limit or feature-restriction mechanism of the App;
- enter a name or content that is unlawful, hateful, harassing, sexually explicit, or that infringes someone else's rights or impersonates another person;
- in Friend rooms, harass, threaten or spam another player, use a name that is offensive or reveals someone else's private details, join rooms you were not invited to (for example by guessing codes), or try to overload, scrape or disrupt the room service; or
- use the App for any commercial purpose, or in any way that violates applicable law.
We may reset modified progress, remove inappropriate names, or restrict access to the App where we reasonably believe these rules have been broken.
4. Virtual items, coins and rewards
The App contains virtual items, including coins, experience points, boards, symbols, avatars, ladder points and puzzle stars ("Virtual Items"). By using the App you acknowledge and agree that:
- Virtual Items are earned by playing and have no real-world monetary value; they cannot be bought with real money, sold, exchanged, refunded or redeemed for cash or anything of monetary value;
- Virtual Items are licensed to you for use inside the App only and are not your property;
- the App version covered by these Terms does not offer in-app purchases or real-money transactions; if we introduce them in a later version, additional terms, including refund terms, will be presented to you before any purchase;
- spending coins on an item in the App is final, and we may adjust rewards, prices, difficulty and availability of Virtual Items from time to time;
- Virtual Items are stored on your device, so they may be lost if you uninstall the App, clear its data or lose your device, and we are unable to restore them.
5. Arena, computer opponents and Friend rooms
Opponents in Arena, Survival, Classic and Battle modes are controlled by the App. Their names, avatars and levels are generated within the App to give you a challenge matched to your skill. Ladder rankings shown in the App are simulated for entertainment. Nothing in Arena should be understood as a ranking against, or a communication with, real people.
Friend rooms are different: they let you play a live match against a real person you invite with a room code or invite link. By using them you agree that:
- your player name, avatar and level are shown to the other player, and your moves are passed to them through an online service run by a third party (see the Privacy Policy);
- anyone who has a room code can join that room, so you are responsible for who you share it with, and for the invite messages you choose to send. Please do not spam people;
- we do not verify, supervise or moderate other players, and the App has no chat. If someone behaves badly, simply leave the room;
- if a player leaves or loses connection, the match ends and the other player is treated as the winner of that match. Friend matches give no coins, experience or ranking;
- Friend rooms need an internet connection and depend on a third-party service, so they may be slow, interrupted, limited or unavailable at times, and we may change, suspend or remove them at any time;
- we may delete rooms and block access to the room service where we reasonably believe it is being abused.
6. Your progress and data
You are responsible for your device and for protecting access to it. Your game data is kept on your device only, apart from the temporary Friend room information described in the Privacy Policy. We are not responsible for loss of progress caused by deleting the App, clearing its data, device failure, a factory reset or similar events.
7. Ownership and intellectual property
The App, including its software, graphics, animations, user interface, sounds, music, text, puzzles, level design and the names "Tic Tac Battle" and "Pulsebyte", belongs to Pulsebyte or its licensors and is protected by copyright, trademark and other laws. Some sound effects are used under open licences such as Creative Commons Zero (CC0) from their creators. These Terms do not give you ownership of, or any right to use, our names, logos or content except to play the App.
8. Updates and changes
We may update, improve, modify, suspend or discontinue any part of the App at any time, including to fix problems, balance gameplay or add features. Some updates may be required for you to continue using the App. We may also update these Terms; when we do, we will change the effective date above, and for material changes we will give notice in the App or on its store page. If you keep using the App after changes take effect, you accept the updated Terms.
9. Disclaimer of warranties
The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Pulsebyte disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and that the App will be uninterrupted, error-free, secure or free from harmful components. Nothing in these Terms excludes any warranty or right that cannot be excluded under the law that applies to you, including your statutory rights as a consumer.
10. Limitation of liability
To the fullest extent permitted by law, Pulsebyte, its owners and contributors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress, Virtual Items, profits or goodwill, arising out of or related to your use of, or inability to use, the App. Because the App is provided free of charge, our total liability to you for any claim relating to the App will not exceed INR 1,000 (or the equivalent in your currency), except where law does not allow such a limit, and nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot lawfully be limited.
11. Termination
You may stop using the App at any time by uninstalling it. We may suspend or end your right to use the App if you break these Terms or if we stop offering the App. On termination, your licence ends and you must delete the App. Sections that by their nature should survive termination (including 4, 6, 7, 9, 10, 12 and 13) will continue to apply.
12. Governing law and disputes
These Terms are governed by the laws of India, without regard to its conflict-of-law rules. Subject to any mandatory consumer rights you have under the law of the place where you live, the courts located in India will have exclusive jurisdiction over any dispute arising from these Terms or the App. Before starting a formal claim, we ask that you contact us so we can try to resolve the matter informally.
13. General
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and Pulsebyte about the App.
- Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
- No waiver. Our not enforcing a right is not a waiver of it.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example in a reorganisation or sale of the App.
- Third-party platforms. If you obtained the App from Google Play, Google's terms also apply to your download. Google is not a party to these Terms and is not responsible for the App or its support.
